Ironfish Pty Ltd (“Ironfish” or “We” or “The Promoter” ) offers brand supporters (“Referrer” or “You”) the opportunity to participate in its referral program (the “Program”). We reserve the right to amend or terminate the Program at any time, for any reason. The Program is administered by Ironfish.

Referrers are bound by these Terms and Conditions by participating in the Program. By participating in the Program, Referrers agree to use the Program in the manner specified in these Terms and Conditions. If you do not agree to these Terms and Conditions in their entirety, you are not authorized to register as a Referrer or to participate in the Program in any other manner. Referrers may not participate in the Program where doing so would be prohibited by any applicable law or regulations.

Information on how to participate and the referral incentive reward value form part of these Terms and Conditions. Participation in this program is deemed acceptance of these Terms and Conditions. Acceptance of these Terms and Conditions is a condition of entry.

Promotion commences at 9:00AM AEST Monday, 4th March 2024 and ends at 5:00PM AEST on Tuesday, 31st December 2024 (“Promotional Period”).

Eligibility

1. The promotion is open to Ironfish customers who have purchased a property with Ironfish. A “completed purchase” is defined as having signed a Property Contract of Sale, paid their 10% deposit, their contract has progressed to Unconditional Status. Referrers must be verified as genuine customers of Ironfish to be eligible.
2. Entrants must be residents of Australia aged eighteen (18) years or over who are customers of Ironfish Sydney, Brisbane or Perth. Clients of Ironfish Melbourne are not eligible. Entrants in regions outside Australia and under age eighteen (18) are not eligible.
3. The referred person “friend” must not currently exist in Ironfish’s contact, prospect or customer database. An eligible friend will be defined as a new customer to Ironfish that resulted from the referral. A customer is defined as a person who has purchased a property with Ironfish. A “completed purchase” is defined as having signed a Property Contract of Sale, paid their 10% deposit, their contract has progressed to Unconditional Status
4. Ironfish property strategists and current Ironfish employees are excluded from participating in the program.
5. Referrers cannot refer themselves.

Qualified Referrals

1. The referred friend must complete a purchase of an Ironfish property through an Ironfish Strategist or staff member after the date that the promotional program start date commences. A purchase is deemed complete once contracts are exchanged and have progressed to Unconditional status and the cooling off period has past, as confirmed by the vendor.
2. The friend had not previously made a purchase with Ironfish under any email address or alias.
3. Only one Qualified Referral can be earned for each referred Friend, up to a maximum of ten (10) referred Friends per calendar year, unless otherwise permitted by Ironfish.
4. Referrers confirm any referral fees paid by Ironfish are of a private nature and not the result of a commercial arrangement.
5. Referrers can make multiple referrals, of unique customers, and must seek to satisfy their own responsibilities to the ATO.
6. Any additional or subsequent purchases made by a referred Friend, after their first purchase, will not be considered a Qualified Referral and thus not be entitled to the benefits of Qualified Referrals.
7. Rewards are subject to verification. Ironfish may delay a Reward for the purposes of investigation. Ironfish may also refuse to verify and process any transaction Ironfish deems, in its sole discretion, to be fraudulent, suspicious, in violation of these Terms and Conditions, or believes will impose potential liability on Ironfish, its subsidiaries, affiliates or any of their respective directors, employees, representatives and agents.
8. All Ironfish’s decisions are final and binding, including decisions as to whether a Qualified Referral, or Reward is verified.

How the Program Works

5. A Ironfish client can enter in all relating referral details here.
6. By participating in the program, a referrer represents that he/she has their friend’s prior consent to provide their contact information.
7. Once a Referrer refers a Friend he/she will be contacted if a qualified purchase is made by the referred Friend within 12 months.
8. If a confirmed purchase is made within 12 months of the received referral, Ironfish will contact the referral and complete ‘Ironfish Referral Reward Payment’ form which instructs details of payment of the reward. This form must be submitted during the Promotional Period and verified by the referrer’s Ironfish Strategist.
9. An eligible referrer who is fully compliant with these terms and conditions may receive “Reward(s)” for every qualified referral of a friend.

Reward Details

1. The reward amount is set at $1000 (GST exclusive) for the first verified referral friend purchase
2. Payment will be made 30 days after contracts are exchanged of the friends purchase as confirmed by the vendor
3. Each $1000 referral payment will be directly credited into the Referral client’s bank account once these details have been verified.
4. Any change to the value of the prizes occurring between the date of these terms and conditions and the date the prizes are claimed is not the responsibility of the Promoter.
5. Prizes are not transferable or exchangeable and must be transferred via a bank account
6. Referrers must seek to satisfy their own responsibilities to the ATO pertaining to any payment made by Ironfish.

Privacy

1. Referrers may participate in the Program made available by Ironfish in order to refer clients to Ironfish. To do this, Referrers must necessarily submit personal information about themselves and the new client, such as name, contact number and e-mail address information, so that Ironfish can send communications to the referred Friend on the Referrers’ behalf.
2. The personal information will be collected, processed and used in accordance with Ironfish’s Privacy Statement, which can be found at https://ironfish.com.au/privacy-policy/. Referrers understand that, in addition to the initial communications to the new client, Ironfish may also use the personal information to send to the new client additional follow-up communications on behalf of the Referrers in order to encourage or remind the new client to complete a purchase.
3. The personal information may also be used by Ironfish to contact Referrers with regards to their participation in the Program and to send to Referrers additional communications from Ironfish.

Entries

1. Ironfish reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who Ironfish has reason to believe has breached any of these Terms and Conditions, tampered with the process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Ironfish’s discretion. Failure by Ironfish to enforce any of its rights at any stage does not constitute a waiver of those rights. Ironfish’s legal rights to recover damages or other compensation from such an offender are reserved.
2. Incomplete or indecipherable entries will be deemed invalid.
3. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
4. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
5. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
6. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; or (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter.
7. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The personal information collected in connection with this Promotion will be used, stored and disclosed in accordance with the Promoter’s Privacy Policy, available at https://ironfish.com.au/privacy-policy/

In the event of a dispute regarding the interpretation of these Terms and Conditions, the decision of Ironfish Pty Ltd will be final.
